Smoking is one of the grey subjects that is both legal and illegal depending on which laws are cited, and this division is even found within the bill of rights, namely a person's right to self defence against those who would do harm without permission, versus a person's right to do themselves harm within the bounds of the definition of sane mind. Of course all of these definitions are based on what a reasonable person considers "harm", "sane", "permission", and other words that are understood differently from person to person.
