I think banning smoking in bars and restaurants is unconstitutional and hypocritical. More people die from alcohol and alcohol related deaths per year than smoking but drinking is still perfectly legal. The federal government has no right to dictate to a private business owner what legal activities they can or cannot permit in their private establishments. If a bar, club or restaurant owner wants to allow smoking, that's their business and anyone who doesn't want to deal with the smoke can eat, drink, dance or work somewhere else. So what if you get your car smog tested? A car that passes those test is still emmitting more carcinogins than a few cigarettes.
